TERMS AND CONDITIONS

These Terms & Conditions of Sale (the “Terms”) are entered into by and between SUBLIME SAS, registered with the Trade and Companies Register under number B 908 092 471 (hereinafter referred to as the “Company”), and any individual or legal entity wishing to make a purchase via the website marierohana.com (hereinafter referred to as the “Customer”).

1. PURPOSE

These Terms govern the contractual relationship between the Company and the Customer and apply to all purchases made through this website (the “Site”).

By placing an order on the Site, the Customer agrees to be bound by these Terms without reservation and confirms having read and understood them prior to completing the purchase.

Before placing any order, the Customer confirms that the purchase of products through the Site is not directly related to any professional or commercial activity and is strictly for personal use; and they have full legal capacity to enter into binding agreements under these Terms.

The Company reserves the right to amend these Terms at any time, in particular to comply with applicable laws and regulations or to improve the functionality and use of the Site. The applicable Terms shall be those in effect on the date the order is placed by the Customer.

2. PRODUCTS

All creations offered on the Site are produced within SUBLIME ATELIER. The Company reserves the right to modify its product range at any time without prior notice.

Each product is presented on the Site with a description outlining its main technical characteristics.

While the Company makes every effort to ensure that product photographs accurately reflect the items offered for sale, images are provided for illustrative purposes only and are not contractually binding.

3. PRICE

All prices displayed on the Site are listed in Euros (€) and include all applicable taxes (VAT included) in effect on the date the order is placed. Any change in the applicable VAT rate may be reflected in the price of the products.

For orders placed from outside the Eurozone, the Customer’s bank or payment provider may apply additional bank charges and/or currency conversion fees. Where applicable, any conversion of the purchase amount from Euros (€) into the Customer’s local currency is carried out solely by the relevant financial institution and is independent of the Company. Such fees remain the sole responsibility of the Customer.

The Company reserves the right to modify its prices at any time. However, the price applicable to the Customer shall be the price in effect on the Site at the time the order is confirmed.

Prices indicated on the Site do not include shipping costs. Delivery charges are applied in addition to the product price and are calculated based on the total amount of the order.

4. PAYMENT

The Company accepts the following payment methods for purchases made on the Site:

  • Credit and debit cards (Visa, MasterCard, American Express)
  • PayPal
  • Apple Pay

All transactions carried out on the Site are secured using encryption technologies to ensure the protection of the Customer’s personal and financial information.

The Company reserves the right to modify the accepted payment methods at any time without prior notice.

Any attempt at fraud or unauthorized payment will be reported to the relevant authorities and may result in the suspension or termination of access to the Company’s products and services.

5. SHIPPING

Orders are dispatched within ten (10) business days from the date of purchase, unless otherwise specified. Once the order has been shipped, the Customer will receive a confirmation email including a tracking number.

Delivery times may vary depending on product availability and the shipping destination. In the event of a delay, the Company will inform the Customer as soon as reasonably possible and provide the reason for such delay.

Shipping costs are borne by the Customer unless otherwise expressly stated in these Terms. Applicable delivery fees will be clearly indicated at checkout before the order is confirmed.

Risk of loss or damage transfers to the Customer at the time the products leave the Company’s premises.

Upon delivery, the Customer is required to inspect the condition of the package and its contents in the presence of the postal service representative, courier, or authorized carrier. In the event of damage during transport, any claim must be submitted directly to the carrier within three (3) days following delivery.

The Company shall not be held liable for any loss, damage, or additional costs resulting from delivery delays, incorrect shipping information provided by the Customer, or any circumstances beyond the Company’s reasonable control.

The Company shall not be liable for any failure or delay in performance caused by events of force majeure. Force majeure refers to any unforeseeable, unavoidable, and external event preventing the performance of contractual obligations, including but not limited to natural disasters, strikes, armed conflicts, or any other event beyond the Company’s reasonable control.

6. TRANSFER AND OWNERSHIP

Title to the products shall transfer to the Customer upon delivery of the order.

Until delivery has taken place, the products remain the exclusive property of the Company.

7. INTELLECTUAL PROPERTY

All intellectual property rights relating to the content made available on the Site remain the exclusive property of the Company. Such rights are protected by applicable intellectual property laws and international treaties worldwide. All rights are reserved.

No person is authorized, without the Company’s prior written consent, to reproduce, distribute, modify, display, exploit, or otherwise use, in whole or in part, any elements of the Site, including but not limited to photographs, logos, visuals, designs, or text.

8. CUSTOMER SERVICE

The Company will make every reasonable effort to respond to requests as promptly as possible.

9. RIGHT OF WITHDRAWAL & RETURNS

In accordance with Article L.221-18 of the Code de la Consommation, the Customer has the right to withdraw from the purchase within fourteen (14) calendar days from the date of delivery of the order, without providing any reason and without incurring any costs other than those provided by applicable law.

To exercise the right of withdrawal, the Customer must notify the Company of their decision in writing by either:

The products must be returned within a reasonable timeframe and no later than fourteen (14) days from the date on which the Customer communicated their decision to withdraw.

The Customer must clearly indicate their full name, order number, order date, and product reference.

Return shipping costs are borne by the Customer. The Company shall not be held responsible for any loss, theft, or damage occurring during return transit. Regardless of the shipping method chosen, the Customer must provide the return tracking number by email to contact@marierohana.com.

Products must be returned in their original condition: complete, unused, unsoiled, and in their original packaging.

In accordance with Article L.221-24 of the Code de la Consommation, and provided that the returned products meet the above conditions, the Company will refund all payments received from the Customer, including the initial standard delivery costs (excluding any additional costs resulting from the Customer choosing a delivery method other than the least expensive standard option offered by the Company).

The refund will be issued within a period not exceeding thirty (30) days from receipt of the returned products.

Reimbursement will be made using the same payment method used by the Customer for the original transaction.

10. WARRANTIES

Legal Guarantee of Conformity: In accordance with Articles L.217-4 et seq. of the Code de la Consommation, the Customer benefits from the statutory legal guarantee of conformity for all products purchased through the Site.

Under this guarantee, the Customer is entitled to request repair, replacement, or refund of any product that does not conform to the contract.

The Customer must provide a detailed description of the defect, clear photographs showing the issue, and proof of purchase.

Warranty Against Hidden Defects: In accordance with Articles 1641 et seq. of the Code de la Consommation also benefits from the statutory warranty against hidden defects for all products purchased through the Site.

This warranty applies to defects that were not apparent at the time of purchase and that render the product unfit for its intended use or significantly impair its use.

To exercise rights under the warranty against hidden defects, the Customer must contact the Company in writing at the email or postal address provided above and include:

  • A detailed description of the defect
  • Clear photographs showing the defect
  • Proof of purchase

The Customer may bring a claim under the warranty against hidden defects within two (2) years from the discovery of the defect, and in any event no later than twenty (20) years from the date of purchase.

11. LIABILITY

In the context of distance selling, the Company is subject to a best-efforts obligation.

The Company shall not be held liable for any damages resulting from the use of the Internet network, including but not limited to data loss, unauthorized access, viruses, service interruptions, or other unintended technical issues beyond its reasonable control.

Nothing in these Terms shall exclude or limit liability where such limitation is not permitted under applicable law.

12. PERSONAL DATA

The Company is committed to protecting the confidentiality of any personal information provided by the Customer in connection with the use of the Site or its services.

Personal data relating to the Customer may be collected, processed, and stored in accordance with applicable data protection laws, including the French Data Protection Act (Law No. 78-17 of January 6, 1978) and the General Data Protection Regulation (EU) 2016/679 (“GDPR”).

The personal data collected may include, but is not limited to: first and last name, postal address, telephone number, email address.

Such data is collected and processed solely for the purpose of fulfilling contractual obligations, including order processing, payment, delivery, and customer service.

Personal data is retained only for the period necessary to fulfill the purposes for which it was collected and in compliance with applicable legal and regulatory requirements.

In accordance with applicable data protection laws, the Customer has the right to access, rectify, erase, or restrict the processing of their personal data. Such requests may be submitted at any time by email to: contact@marierohana.com

13. DISPUTE RESOLUTION

In the event of any dispute relating to the interpretation or performance of these Terms, the parties shall first seek to resolve the matter amicably.

Failing an amicable agreement, the dispute shall be submitted to the competent courts of the jurisdiction in which the Company’s registered office is located, unless otherwise required by mandatory consumer protection laws.
